European Electronic Communications Code Notice
Effective: April 23, 2026
The European Electronic Communications Code (Directive (EU) 2018/1972) (the “EECC”) requires us to provide users in the European Union with certain information about the electronic communications service we provide as part of X’s Chat feature. This Notice supplements the X User Agreement, including the Terms of Service and Privacy Policy. Applicable users may include microenterprises, small enterprises, or not-for-profit organisations, unless they have expressly agreed to waive all or part of the protections under Article 102(1), (3), and (5) EECC.
X Chat
The latest version of X includes a new Direct Messaging feature (“Chat”). When entering Chat for the first time, a private-public key pair is created for each user. Users are prompted to enter a PIN, which is used to keep the private key securely stored on X’s infrastructure. X uses a per-conversation key to encrypt message content, and employs cryptographic schemes to encrypt messages, links, and reactions before they leave the sender’s device and while they are stored on X’s infrastructure. Previous messages sent prior to the change to Chat remain available in the inbox, but are not encrypted unless and until the conversation is upgraded to Chat.
The contents of an encrypted Chat message are encrypted, including links, media, files, and reactions. Associated metadata, such as recipient and creation time, is not encrypted. There is no limit to the number of devices that can use Chat. The current implementation is not “forward secure.”
Quality of Service
Chat is provided as part of the Services on an “AS IS” and “AS AVAILABLE” basis. The Services may change from time to time, and X may stop providing the Services or any feature within the Services, permanently or temporarily, and may create limits on use and storage at its discretion. We do not commit to any minimum quality of service level for Chat. Availability and performance may be affected by factors outside X’s control, including device compatibility, network connectivity, internet service provider performance, and other third-party services or infrastructure.
Security
X employs cryptographic schemes to encrypt each message, link, and reaction that are part of an encrypted conversation before they leave the sender’s device and while stored on X’s infrastructure. With respect to any associated metadata (e.g., recipient, creation time, etc.), X reserves the right to detect, prevent, and address fraud, security, and technical issues, and that it may, to the extent possible, access, read, preserve, and disclose information where it reasonably believes this is necessary for those purposes or to comply with law, enforce its Terms, respond to support requests, or protect rights, property, or safety.
Price
We do not currently charge a fee for use of Chat, unless we expressly state otherwise. We reserve the right to introduce fees, charges, or other pricing for Chat, or for certain features or functionality of Chat, at any time in accordance with the Terms of Service and applicable law. You are responsible for any charges from your mobile carrier, internet provider, or other third-party services used to access or use Chat.
Duration, Renewal and Termination
You may end your agreement with X at any time by deactivating your account and discontinuing your use of the Services. X may suspend or terminate your account or cease providing all or part of the Services if we reasonably believe, among other things, that you violated the Terms or the X Rules, created risk or possible legal exposure, engaged in unlawful conduct, were inactive for a prolonged period, or where provision of the Services is no longer commercially viable.
Information You Provide
To create an X account, you must provide certain information, including a display name, username, password, email address or phone number, date of birth, display language, and, if applicable, third-party single sign-in information. Users may also choose to share additional information, such as location, address book data, and account preferences.
When you use X, we collect information about your activity on X, including metadata related to encrypted messages and, when you use legacy Direct Messages, the contents of the messages, the recipients, and the date and time of messages. X's Privacy Policy describes how X handles information provided when you use the Services. The information you provide is subject to and processed in accordance with the specific rules and requirements under the EU Directive 2002/58/EC, where applicable.
Accessibility
X includes accessibility features designed to support users with different disabilities and access needs. Additional information about available accessibility features may be found in X’s Help Center.
Disputes and Complaints
If you have any questions in respect of Chat, you can contact us.
For information about how disputes will be handled between us, including information on which governing law and venue applies, please see Section 6 (“General”) of our Terms of Service.
Finally, you may have the right to refer disputes relating to matters related to the Chat feature and covered by the EECC to an independent arbitration body in your country for dispute resolution. Emergency Services
Chat does not support calls or communications to emergency services or public emergency service answering points.
Relationship with the Terms
This Notice supplements the X User Agreement. Except as expressly modified by this Notice, the Terms of Service and other applicable terms governing the Services continue to apply to Chat. If there is any inconsistency between this Notice and those terms regarding matters governed by applicable EECC requirements, this Notice will prevail to the extent required by applicable law.
